Child Support Enforcement

Child Support Enforcement Attorney

Calculating San Mateo Child Support :: Jonathan G. Chance, Esq. discusses Child Support in San Mateo County

Enforcing child support orders won't happen by itself. It's up to you to make sure your ex is paying what's due. You can ask the department of child support services to manage and enforce payments for you. You can also bring your ex to court.

Typically, if you want the courts to make sure you're getting your child support payment, you will have to file an affidavit with enough information to support a contempt of court charge. If the court finds your ex guilty of contempt of court, the judge can send your ex to jail for up to five days, and pay fines for each violation. In child support contempt cases, the court considers each month of missed payments a separate count of contempt. When your ex is found guilty of missing several months of payments, the amount of possible jail time can be huge.

Sometimes enforcement of an existing child support order will be assigned to the department of child support services. This government agency has various tools to enforce payment of child support and collection of child support arrearages, including wage garnishments, levying bank accounts and property, revocation of the parent’s California driver’s license or professional licenses.

Whether you need to enforce an existing child support order, or find yourself the target of an enforcement action, our experienced child support attorneys can provide you the aggressive and skillful lawyer you need.
